1. Acceptance of Terms

By engaging Intelyra's services, you agree to be bound by these Terms of Service and our Privacy Policy. These terms form a legally binding agreement under Australian law.

2. Our Services

Intelyra provides AI automation services to Australian businesses. Specific deliverables, timelines, and pricing are agreed in individual service agreements or statements of work. We commit only to capabilities we can demonstrably deliver.

3. Australian Consumer Law Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). If a service fails to meet an ACL consumer guarantee, you may be entitled to a remedy including a refund, replacement, or re-performance of the service. Nothing in these terms is intended to limit any right you have under the ACL.

4. Your Obligations

You agree to:

• Provide accurate information when engaging our services
• Use our services only for lawful purposes
• Comply with all applicable Australian laws including the Privacy Act 1988
• Not share access credentials or misuse the platform

5. Intellectual Property

Intelyra retains ownership of its platform, technology, and proprietary methodologies. Your data remains yours. We do not claim ownership of any data you provide to us, and we will not use it for any purpose beyond delivering your services.

6. Data & Privacy

We handle all personal information in accordance with our Privacy Policy and Australia's Privacy Act 1988. Your data is processed and stored in Australia.

7. Limitation of Liability

To the maximum extent permitted by law, Intelyra's liability is limited to the amount paid by you for the relevant service in the 12 months preceding the claim. This limitation does not apply where prohibited by the Australian Consumer Law.

8. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes with reasonable notice. Continued use of our services after notification constitutes acceptance of the updated terms.
